 416ビザとは？

416ビザは、正式名称を、

416スペシャル・プログラム・ビザ
(Special Program Visa Sub Class 416)

....と言います。

つまりその名の通り、スペシャルなプログラムのためにオーストラリアに滞在しようとする人のために用意されたスペシャルな(特例的な)ビザ。

みなさんもご存知のように、よく知られているビザには、学生ビザや永住ビザ、観光ビザ、ワークビザ、ワーキングホリデービザなどがありますが、渡航者が多いと、どうしてもそれらのカテゴリーに該当しない渡航目的（プログラム）というものが出てきてしまいます。

例えば、観光でもないけど、通学するわけでもないので学生ビザでもなく、でも無給ボランティアなのでワークビザでもない、といった日本語教師アシスタントなどのボランティアでオーストラリアに滞在しようとする人など、主要なビザカテゴリーで裁けない滞在者を、この“スペシャル”なビザでオーストラリアは対応しているのです。

このようなビザカテゴリーを用意してくれていることからも、オーストラリアは移民や外国からの訪問者に寛容な国であることがわかりますね。

ちなみに416とはオーストラリアの各ビザに振り分けられた認証番号で、例えば、ワーキングホリデービザは417（サブクラス417）、観光ビザ(ETA)は976 と呼ばれています。

さて、話をまとめますと、416スペシャルプログラムビザとは、

Answer:
特別なビザで、ボランティアで日本語教師をしてみたい人、
つまり日本語教師アシスタントにピッタリのビザ、ということになります。

Point:
・オーストラリア出入国は何回でも可能。
・ビザ有効期限は派遣校での活動期間以内。最長365日まで。
・アルバイト含めた、有給の就労はできません。
・3ヶ月以内のパートタイム等非正規コースなら語学学校通学は可能

----------（解説)----------

オーストラリア移民局の416スペシャル・プログラム・ビザ(サブクラス４１６;Special Program Visa Sub Class 416)の説明では、「青少年の交流および“組織化された労働を目的とした訪問”に参加する人々に発給されるビザ」としています。

例えば、移民局に認定されているSLAPプログラム下での「日本語教師アシスタント」プログラムのような特別なプログラムに参加する人々に発給されます。

参加者は、特定の青少年交流プログラムや、公共団体がおこなっているプログラムに参加することにより、異国での見聞を広げることができます。

一方、オーストラリアの受入れ団体にとっては、異文化交流や国際親善の機会を創造できるというメリットがあり、画期的なビザです。

日本人の場合、日本語教師アシスタントとしてこのビザを取得する場合がほとんどですが、フルブライト奨学金による留学プログラムや、一部のビジネスインターン（有給）* でも、このビザを利用することができます。
*...ビジネスインターンで有給になるかどうかは参加期間や参加者の能力及び雇用主にもよります。

■申請条件
１．若くて健康な者(18歳以上29歳と364日以下)
２．認定されている団体（学校）から受入れを許可されていること
３．宿泊施設と滞在中の生活を保証できること
４．オーストラリア大使館指定病院の健康診断で異常が認められないこと

※12ヶ月以上の教員経験がある者はこのビザが認められないとの一部アナウンスを
　しているエージェントがありますが、2007年8月現在、移民局に確認したところ、
　そのような明確な規定はないとのこと。ビザの規定はその都度変わり、審査官や
　エージェントと移民局との相性によっても変わりますので、ご注意ください。

※ビザ申請料$190(2007年7月現在)←どんどん値上がり中
※30歳以上、31歳未満の場合はグレーゾーン。明確な規定はなく、審査官によって判断が異なるが、実質は、30歳を超えた時点で申請はあきらめたほうがよい。

■あくまでボランティア
416スペシャル・プログラム・ビザを取得するには、申請者は日本語や日本文化を海外の学生に教えるというような教育関係の仕事に興味を持っていることを示さなければなりません。将来、教師になりたい人にはたいへん貴重な体験となるでしょうし、オーストラリアの社会そのものに触れてみたいという人にも、教育の現場で教師、両親、子供たちと出会い、それぞれが置かれている状況や問題を知るよい機会になることでしょう。

しかし、このプログラムは、オーストラリア人日本語教師の後任を探す目的での採用は認めておらず、この416ビザを持っている人は、そのまま有給の学校教師(日本語教師)になることはできません。

あくまでボランティアなので、滞在場所と生活費を準備する必要があるが、ほとんどの受入校が安価でホームステイ(週A$100〜150ほど)を提供してくれています。

また、学校での任務は、専任の語学教師(日本語教師)のアシスタントという任務だけに原則、限られています。（実際は、学校の状況によっても変わってきます。）

このプログラムの参加者(日本語教師アシスタント)を受け入れるには、学校側が移民局から認定を得ていなければなりません。

○ワーキングホリデー(ワーホリ)ビザ→416ビザ
○観光ビザ→416ビザ
○ビジネスビザ→416ビザ
○教職員ビザ→416ビザ

  （ビジネスビザはこれまでの経験や技術から査定されるので1年未満のインターンは評価対象外）
×416ビザ→ワーホリビザ（一度日本に帰国してワーホリビザ申請すればOK）

例えば、日本語教師アシスタントとして派遣された学校に、日本語教師の空きができた場合など、通常、日本での教員免許を持っており、実務経験があれば、そのまま学校からスポンサーされて、教職員ビザへの切り替えが可能な場合がごくごく稀にあります。
 
但し、日本語教師として、英語圏・欧米圏で有給で働くのは、たいへん険しい道のりです。こちらのページでも日本語教師に関連する概要を説明してますので、ご参考にしてください。

■オーストラリアで日本語教師になるには？(資格/アルバイト・パートタイム/待遇等)

それ以外の場合は、ビザの種類によってはオーストラリア国内でしか申請できないビザがあるので、注意が必要です。

416ビザで日本語教師アシスタント活動中のアルバイトや語学学校について移民法上、このビザを持っている方は、一切の有給の就労はできません。

また、日本語教師アシスタント以外のボランティアをする場合も、禁じられています。

もし日本語教師アシスタントが有給の仕事をすると、移民法上、違反となり、ビザが取り消されることもありますので、ご注意ください。

語学学校に通うことに関しては、3ヶ月以内の非正規コースであれば、通学・受講することが可能です。これは観光ビザと同様の基準となっています。
日本語教師アシスタントの皆さんは、日本語教師アシスタント活動している学校で、いろいろなクラスの授業を聴講させてもらったりしています。英語をぜひ勉強されたいという場合は、日本語と英語の交換授業(Language exchange)をしてもらったりしている方もいらっしゃいます。これらについては、移民法上の問題はありません。

I  am  pleased  to  advise that the application for a subclass 416 Special Program)  visa  by  JEGS, TARO has been approved.  The visa provides for  multiple  entries  to  Australia and is valid until the date specified above.

This letter contains important information about this visa and the visa conditions.

VISA GRANT NUMBER
The visa grant number is 03##9999#9999.  This is the unique number assigned to the visa.  Visa holders should keep this visa grant number with them, as they may have to provide it to the Department during the life of the visa.

VISA INFORMATION
This visa permits you to stay in Australia until the date specified above. It provides you with multiple travel to Australia, which means that you can leave Australia and re-enter Australia as many times as you wish during period of your approved stay.  It is important that you do not enter Australia until the date of arrival advised in your Special Program visa application. If you arrive before this date you may be in breach of your
visa conditions (see below) and your visa may be cancelled.

PASSPORT
Your visa is linked to the passport number that you provided in your application.  If you obtain a new passport after receiving this letter, you will need to e-mail the Helpdesk and advise the Department of your new passport details.

Please note: If you do not provide us with the details of any new passport issued to you, you may experience significant delays at the airport and may be denied permission to board your plane.

VISA LABEL NOT REQUIRED
You will not have a visa label placed in your passport when travelling to Australia. It is recommended that you print and keep a copy of this advice for your personal records.
However, applicants should check with the relevant authority in their country to verify if a label is required prior to travel.

VISA CONDITIONS
It is very important that you understand and abide by your visa conditions. If you fail to abide by these conditions, your visa may be cancelled and you will be required to leave Australia.

Your visa has been granted subject to condition 8107.  This means that if you wish to change employer or occupation you must notify the Department and may need to apply for a new visa beforehand. Failure to do so may result in cancellation of your visa and removal from Australia of you and any family members.

Applicants should also be familiar with the general guidelines on unpaid work, work experience, internships and trial work available on the Department of Employment and Workplace Relations' website at wagenet.gov.au

If you do not understand your visa conditions please contact the nearest Australian Government Office overseas for advice before you travel .

After arrival in Australia, you may seek advice on any aspect of your visa conditions from the Special Program Helpdesk by emailing or the nearest DIMIA office.

Please note that your Special Program Visa has been approved subject to a number of conditions:

8107
The holder must not:
(a) if the visa was granted to enable the holder to be employed in Australia:
(i)   cease to be employed by the employer in relation to which the visa was granted; or 
(ii)  work in a position or occupation inconsistent with the position or occupation in　relation to which the visa was granted; or
(iii) engage in work for another person or on the holder’s own account while undertaking　the employment in relation to which the visa was granted; or
(b) in any other case:
(i)   cease to undertake the activity in relation to which the visa was granted; or
(ii)  engage in an activity inconsistent with the activity in relation to which the visa was granted; or
(iii) engage in work for another person or on the holder’s own account inconsistent with the activity in relation to which the visa was granted.

However, as the visa is supported under the Youth from the USA Program it is understood that the visa holder may undertake a change of employer without seeking the permission of the Department.  All employment however must be consistent with the objectives of the Special Program Visa and meet appropriate State or Federal Industrial Relations requirements.

CHECKING YOUR VISA DETAILS
The Department has developed a new service called Entitlement Verification Online (EVO) which allows certain third parties to check your visa information with your consent.

Through EVO, you can give your consent to registered third parties such as:
- employers and labour suppliers, to help check whether your visa allows you to work in Australia;
- government agencies, to help assess your eligibility for services;
- licensing authorities, to help establish your eligibility for a licence; and
- educational institutions, to assess whether you can study in Australia.

The disclosure of your visa information by the Department is governed by the Privacy Act 1988.  Therefore, the Department will disclose information about your visa to a third party only with your consent.  You can consent to an inquiry about your visa entitlements by giving the third party your name, date of birth, passport number and passport country of issue.  If you do not wish a third party to find out about your visa entitlements, do not give them this information.

The information form 993i 'Safeguarding your personal information', available from Immigration offices, gives details of third parties to which you can consent to your personal information being disclosed, and how you can consent.

Employers and organisation will be able to access the service on the Department's website under 'Online Services' >>  'Entitlement Verification Online'.
